IT AFFECTS YOUR LEGAL RIGHTS. 12.1 Binding Arbitration: Any dispute or claim arising out of or relating to these Terms or your use of the Services shall be settled by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement. 12.2 Class Action Waiver: You and TrueFresh agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

SECTION 13 - GOVERNING LAW These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

SECTION 14 - SEVERABILITY & WAIVER If any provision of these Terms is deemed unlawful or unenforceable, that provision shall be severed, and the remaining provisions shall remain valid. Our failure to enforce any right or provision does not constitute a waiver of such right.
